Lead is highly toxic and affects virtually every system of the body. Lead in the bloodstream can cause damage to the brain and nervous system resulting in reductions in IQ and attention span; reading and learning disabilities; hyperactivity; behavioral problems; blindness; brain damage; coma; convulsions and death. Lead is virtually indestructible.
While lead is harmful to persons of all ages, lead exposure is especially harmful to children age 6 or under because lead's neuro-toxic effects have the greatest impact on the developing brains and nervous systems of young children. Lead poisoning has been referred to as the "silent disease" because its effects often occur gradually and imperceptibly, showing no obvious symptoms. Childhood lead poisoning has been labeled by the Centers for Disease Control ("CDC") of the U.S. Department of Health and Human Services as the number one environmental health hazard facing American children.
Although landlords have been held responsible for a child's exposure to the lead-based paint that is commonly found in older rental property, they often fail to have sufficient insurance or other resources to adequately compensate the injured children. Lawsuits recently filed in several states seek to hold the paint and lead pigment manufacturers responsible for the injuries caused by their products.
